Employee Privacy Notice Policy

The Brighton Pier Group PLC (BPG) believes strongly in protecting the privacy of the personal data you will be providing us. We also believe it is important to inform you about how we will use your personal data. This document explains how BPG may process your personal data and the rights you have in this respect. Therefore, we encourage you to read this Privacy Notice carefully.

Please note this is not your contract of employment.

Scope of this Privacy Notice

This Privacy Notice applies to all personal data of job applicants processed by BPG in connection with its recruitment process. Such data is processed under the responsibility of the specific site you applied to work at and are now an employee as well as under the responsibility of The Brighton Pier Group PLC all of which are based solely in the UK.

Type of data we collect

In order to ensure that you are correctly placed on our payroll and in order for us to validate that we have entered into a contract of employment with each individual and that we have established the identity of each individual we will require certain information solely for the pursuance of the contract of employment. This information is as follows; 

  • Personal data confirming identification of each employee and practical organisational requirements: first name, surname, address and country of origin via passport, birth certificate or national ID card *, age**, email address, telephone number.

*Country of origin is required during employment to allow us to validate your right to work and for our records to be able to demonstrate due diligence in this matter.

**we require age as certain areas of the company ae age restrictive by law.

  • Personal data confirming bank account details, National Insurance Number for the sole purposes of payroll.
  • Next of Kin details, this is name, relationship to you and contact email or phone number. The individual named must be over 18 and the information is necessary in order to contact someone in the event of an emergency. In addition, it is a condition of your employment that you have actively sought permission from the person to be so named as your next of kin for their personal details to be used as such.
  • Personal data allowing the verification of the eligibility and selection criteria used by BPG as laid down in the vacancy notices, for skilled and management roles only.
  •  Education and training (diploma awarded), professional experience (job title, length of service, company name, company type and web address of company (optional), main tasks and responsibilities), linguistic and job related skills and competencies and areas of interest. 
  • Please note that we may ask for information such as gender, race and ethnicity for the purposes of monitoring equal opportunity. This would be a separate form which would be anonymous and not held on your file.

 Third parties

Your personal data will not be shared with any third parties and only used in the pursuance of your contract of employment and your eligibility to enter into this contract.  Any other disclosures to third parties will only be made when required by law or as a result of host or server activity used by BPG subsidiaries which are based abroad and are utilised solely for the dissemination of data ‘flow’ and storage of data* .

 *BPG requires these third parties to provide confirmation of a comparable level of protection to your personal data as BPG provides, to keep your personal data confidential, to only process your personal data for the purposes for which it was disclosed and to only access the minimum amount of data they need to deliver a specific service related to the legal requirement or data storage and flow.

Data Storage

All your personal data, once collected for the pursuance of the contract of employment and to facilitate payroll requirements which is also in pursuance of the contract, is transferred electronically to the main HR and Payroll servers.

Eclectic Bars: – No hard copies of your information are kept on site after the period of one week other than basic contact details of name, phone number and email address which are held on the server at site and only accessible through encryption by the site Management.

*During this week, the hard copy information is kept in a locked and secure place accessible only be nominated senior site management. The location of storage will have, in all cases for each BPG site, been checked and verified as suitable for the purpose.

Brighton Palace Pier: – All hard copies of your information are kept in the payroll department and are retained in a secure environment with restricted access.

Paradise Island Adventure Golf: – All hard copies of your information are retained at site and are held in a secure environment with limited access. 

Data Retention

BPG will take all reasonable steps to ensure that we retain your personal data only for so long as is necessary for the purpose for which it was collected which is in pursuance of a contract of employment, or as required by applicable law.

Should you leave the company all personal data which is not applicable to be retained by law will be deleted after a period of no less than 3 months, this includes address, contact details and next of kin.

If you leave your employment with BPG and do not give notice and as such do not confirm your place of abode on leaving, your P45 will remain stored with the payroll department of your Division for a period of three months from your last working day. It will then be destroyed to prevent data leakage

Should your information have been shared with a third party in pursuance of a legal obligation, that third party will be informed of your departure from the company in order for them to commence their data removal procedure.

We will endeavor to keep your information updated, to achieve this we will request from all employees annually or as an attachment reminder to emailed wage slips, an updated details list. should your details change in the interim during your employment please inform your Manager.

In addition exit interviews will be performed to ensure final contact details are correct and to inform you directly of what will happen to your information on the cessation of your contract of employment with the Company.

Data Security

BPG recognises its responsibility to protect the information you entrust to us. BPG maintains, and requires its third-party partners to maintain, technical and organisational measures to protect your data.

Your rights

Once you have provided us with your personal data, you will be able to access this information. Your data subject rights

  1. You have the right to information about what personal data we process, how and on what basis as set out in this policy.
  1. You have the right to access your own personal data by way of a subject access request (see above).
  1. You can correct any inaccuracies in your personal data. To do you should speak to your manager.
  1. You have the right to request that we erase your personal data where we were not entitled under the law to process it or it is no longer necessary to process it for the purpose it was collected. To do so you should contact [email protected] .
  1. While you are requesting that your personal data is corrected or erased or are contesting the lawfulness of our processing, you can apply for its use to be restricted while the application is made. To do so you should contact [email protected] .
  1. You have the right to object if we process your personal data for the purposes of direct marketing.
  1. You have the right to receive a copy of your personal data and to transfer your personal data to another data controller. We will not charge for this and will in most cases aim to do this within one month.
  1. With some exceptions, you have the right not to be subjected to automated decision-making.
  1. You have the right to be notified of a data security breach concerning your personal data.
  1. In most situations we will not rely on your consent as a lawful ground to process your data. If we do however request your consent to the processing of your personal data for a specific purpose, you have the right not to consent or to withdraw your consent later.   1. You have the right to complain to the Information Commissioner. You can do this be contacting the Information Commissioner’s Office directly. Changes to this Privacy Notice

This Privacy Notice may change from time to time. The most current version of the Privacy Notice will always be available at site. The most recent version shall supersede any and all other versions of this Privacy Notice. BPG reserves the right to change or modify this Privacy Notice at any time and at its sole discretion by posting revisions.  Therefore, we encourage you to check back often to learn about those changes.
